A member of the National Guard in West Texas has been charged in connection to a sexual assault investigation
Luis Ontiveros, 30, has been charged with Sexual Assault, a 2nd Degree Felony.
According to an arrest affidavit, an officer with the Alpine Police Department was called out to America's Best Value Inn on East Highway 90 Monday morning for a report of a sexual assault.
There the officer met with a woman who claimed that a man identified as Ontiveros had sexually assaulted her.
The woman stated that she had been drinking with others in another hotel room when she threw up. That's when Ontiveros offered to take her back to her room to go to sleep.
The woman and Ontiveros made it to her hotel room where she laid down in bed. It's then that the woman told police that Ontiveros told her that "if she did not wake up he was going to kiss her."
According to the affidavit, Ontiveros then proceeded to remove the woman's clothes and sexually assaulted her before she was able to leave the room.
The woman went to the hotel room next door where she knocked repeatedly asking to be let in. The man inside the room opened the door to find the woman in the nude saying that Ontiveros had tried to rape her.
Ontiveros was then placed into custody by police and was taken to the Alpine Police Department.
Alpine police say that Ontiveros is a member of the National Guard. CBS7 has reached out to the National Guard for comment on the arrest.
