Christopher Munguia has been charged with aggravated assault with a deadly weapon.
According to the Ector County Sheriff's Office, their deputies were called to the 4400 block of North Mark Twain Avenue on Wednesday night for a disturbance.
When deputies arrived at the scene they found a victim, later identified as landlord Jose Rey, with injuries to his head.
Rey said he and his wife were fixing a mailbox on a property that they rent out when a woman ran from a nearby trailer.
"She was crying," Rey said. "Saying 'he's going crazy'. That he's going to kill a dog or puppy or something. I said 'Who?' and she said 'Chris, he's freaked up'."
Rey says that when tried to intervene, Munguia turned the gun on him.
"I said 'Chris what's the problem?'," Rey said. "He said 'the problem is you' so he shot me right in the face. From about six feet away from me. I went to the ground, started fighting with him. And I was bleeding to death."
Rey was taken to the hospital, treated and released. He said the alleged shot only grazed his head.
"I was a real lucky man," Rey said. "Doctors said I was a real lucky man."
While the sheriff's office has yet to determine whether Rey's injuries were from the shooting or the physical altercation, hospital discharge papers given to CBS7 by the family show that Rey was treated for a "gunshot wound of scalp."
As of Thursday night, jail records show that Munguia is still in the Ector County Jail, with bond set at $20, 000.
