ODESSA, Tx (ODESSA AMERICAN) -- A 38-year-old man reportedly spit in a police officer’s face after he was arrested for driving while intoxicated.
Alfonso Montoya was charged Thursday with harassment of a public servant, a third-degree felony, and driving while intoxicated, a class B misdemeanor.
Officers saw a black 2017 GMC Terrain run a stop sign at a high rate of speed at 10 p.m. in the intersection of E. Sixth Street and N. Grandview Avenue, the Odessa Police Department affidavit detailed.
A traffic stop was conducted as the Terrain stopped at the intersection of E. Eighth Street and N. Grandview Avenue, the Odessa Police Department affidavit stated. Montoya was identified as the driver of the Terrain.
Montoya reportedly had a smell of an alcoholic beverage coming from his breath. He was instructed to exit the vehicle for a DWI investigation.
The investigation showed Montoya was driving while intoxicated and he was arrested and placed in the back seat of the officer’s patrol unit, the affidavit stated. As the officers read the statutory warning DIC 24, Montoya spit in the officer’s face.
Montoya intentionally and knowingly came into contact with his saliva with the intent to assault, harass or alarm the officer, the affidavit detailed.
Montoya was arrested, charged and transported to the Ector County Law Enforcement Center. He has two bonds totaling $55,000 and was still in custody as of Friday afternoon, jail records show.
