PECOS, Texas (KOSA) -

A man is in police custody after he was caught on tape confronting Pecos officers with a rifle.

Carlsbad police reports the man, who was shot by officers, was on the run after he allegedly killed his wife in New Mexico.

CPD said authorities have been looking for that man, identified as Bernardo Fernandez, since his wife was found dead with head injuries after police responded to a domestic disturbance call.

Police said later on in the day, Fernandez was pulled over by a deputy.

We spoke to the man who captured video of his shootout with police and he told us before he started recording, he saw Fernandez get out of the car and fire a few random shots into the air.

“I could hear him yelling but I didn’t know exactly what he was saying,” Jesus Arzola said. “I could just hear him and he was just like saying some stuff and moving the firearm around. I mean, everyone at the restaurant was scared.”

Then Fernandez started walking toward officers holding what looks like a hunting rifle.

After he was shot, Fernandez fell to the ground and tried to reach for the gun yet again before officers cuffed him.

Soon afterward, first responders treated his wounds at the scene and a Arzola said Fernandez continued to fight back even as he lie there bleeding.

“He was still, I don’t know if he was trying to grab his gun which was down there,” he said. “I don’t know what he was trying to do, but he was still fighting the officers back.”

The Department of Public Safety said Fernandez is being treated at Medical Center Hospital in Odessa and is in critical but stable condition.

Reeves County charged him with aggravated assault with a deadly weapon and CPD is pursuing a murder charge.
