No Charges will be Filed in Deadly Motorcycle Crash in Midland 2/22/13

No charges will be filed in the motorcycle fatality that occurred on Feb. 5 at the intersection of Big Spring Street and Loop 250.
After a lengthy investigation, Midland Police Department investigators have determined that 36-year-old Joe Montemayor, of Midland, was faced with a red light at the moment he entered the intersection, which led to the collision. Investigators are still awaiting results of Montemayor’s toxicology report.
Montemayor was traveling southbound on Big Spring Street on a Harley Davidson motorcycle at approximately 4:07 p.m. on Feb. 5 and was passing through the intersection of the south service road of Loop 250 when he was struck by a Ford F-150 pickup traveling eastbound on the south service road.
Montemayor was pronounced dead at the scene. He was not wearing a helmet. The driver, who was the only occupant of the pickup, was not injured.
